View Full Version : Help, hit pot-hole!!!

Just after a little advice really.

I hit a pot hole yesterday, and this morning realised I had a flat - on closer inspection the tyre has split, and looks like the cause was a mamouth pot hole I hit yesterday.

Now I have a spare tyre, but If i fit it, then Im gonna be out of pocket - especially as the tyre thats burst has only done a couple of K miles.

Ive heard about people taking claims like this to the council - anyone got any advice?

Get photos of the hole and the tyre etc.
Then approach the council. It really doesn't hurt to ask.
Check your suspension too!!!

Yes.

I had the same happen with a bike wheel. Quite an expensive one.

Phone the local council and found out who is responsible for the highways.

Then write a nice letter including photos of the pot hole and a photo of the damage to your tyre. If you have damaged the wheel as well you might need to photo this too.

Also include a reciept or estimate for repairs from the most expensive source you can find.

Next write a nice letter informing the chap from the council about the pot hole and your predicament. Explain that you would like recompense for the damage.


They should write back with a cheque. IF not a second letter will be needed explaining that if they don't pay up you intend to pursue a claim in the small claims court and this would obviously result in an additional claim for costs.


After that it is the small claims court. I doubt they will want to do this though. More likely they will just pay up.

Although an X's dad had the same problem, and they refused to pay up.. (Oh her dad was a magistorate, and didn't seem to think they had a case). Weirdos. http://300zx.co.uk/200sx/ubb/smile.gif

I thought you could only do them if the hole had already been complained about ... if you are the first complaint then you dont have a foot to stand on.

Check your alloy first m8 as it may well have put the rim out of shape. If so then include this in the letter. A mate did this when He hit a hole in his BMW Z1 and after some wriggling the council paid up.

If the council haven't checked that particular road for pot holes etc for a certain period of time (no idea how long) then I think you have a better case against them.

when you take a pic of the hole stuy, put a newspaper next to it so the date the hole was there can be verified.

I'm in the same situation mate. Ive done just as Turbo Pete says. My claim is for just over £900!! Received a letter from the council saying that theyve passed on my details to May Gurney who are responsible for highway maintenance. I'm hoping they will pay out, there were about 6 other cars damaged by this pothole, it was a biggun!! :(

Jack up the car and spin the wheel to see if there is any lateral or horizontal distortion of your wheel as that's gonna be expensive if it's bent badly. Get the tracking checked as this will throw up any alignment problems which may indicate suspension being bent :eek: You could get a friendly garage to take a look and see if the trackrod or any of the linkages are bent as these are usally the most susceptibale to impacts. Get a complete package of your claim together and then go to the council and be Mr Nice to start with! Good luck m8 :D
