since december 13th 2003 the boss has been overpaying her and now is demanding it back by two instalments in two months

well i believe that legally it HAS to be paid back...but i would imagine you'd be quite within your rights to negotiate paying it back over a time that's suitable for you (within reason).

happened to me at work...they wanted it back in one go, everyone told them go f*ck off, so we're paying it back over 3 months.

I'm assuming you and your Missus 'Hadn't noticed' that you were getting the extra money, in which case they can't demand it back unless you agree to the terms surely???

She legally has to pay it back as she has dishonestly aquired money off her company. Whether she knowingly did or not is semi irrelevant as she should have a pay slip and its up to her to check it every month.

Technically they can ask for it back how ever they like as its their money, but most companies will, as a goodwill gesture, negotiate the payments thats suitable with the employee. It would be pointless to ask an employee to pay it back in such a way that it might affect the employees finances in such a way they couldnt afford to get to work etc.

They cant just take the money back as its unlawful to withhold wages so it must be consentual

There was a thread along these lines a little while ago but I can't find it :annoyed: Very similar and some one had actually quoted the law about it and it went in the employees favour. Maybe someone who can use the search features better than I, or remebers the thread can find it but it is deffo worth digging out chris.

click on the search at the top of the page that will search the whole forum, the search at the top right of eact section , non200 s14 tech etc will only search in that section.
