on the 1st of feb this year i tw@ted a pothole and knacked 2 tyres and put flat spots on my alloys,the hole was directly after a speed bump and i was only going 15-20 mph at the time and as it was one of them bumps that are square and you have to aim the car to go over them, the hole was unavoidable.
i stopped soon as i did it only to see the tyres with big bleebs in the walls :cry: on the path at the side of the hole there was around 15 to 20 smashed hub caps so it looked like loads of ppl had hit this hole.
i went home grabbed the camera and took some photos then rung the council and got a claim form anyway this morning i got a letter of the councils insurer with a denial of liability.
i rung the insurance company up just now and they are saying that the road was inspected on the 21st of jan and was reported as no defects and as such have forfilled the legal obligations,i could have reached down the phone and strangled the poncy queen i talked to,the smug baztard :smash:
has anyone ever claimed for this sort of thing and got the repairs done?
i need to know what to do next,do solicitors take this sort of thing on no win no fee

Did you not get a picture of the pot hole in question?

You might have a case for argument then :)

my situation was very similar, i wrote to the council and got a letter from their insurance company denying liability cos it was inspected 9 months before. I wrote back asking for the inspection report (so do that anyway, even if just to make them work a bit more for you!)

just got another one back with the inspection report, again admitting no liability so... its legal action or leave it. to be fair, they aren't psychic and i've gotta trust that they didn't know about the pothole (even tho it had bee n there for months!) so I won't bother taking it further and just avoid that bloody road. :mad:

basically. make sure you get a copy of the inspection report, which shows all defects when it was inspected and gives the exact location (measured in 'chainage' - don't know what 1 chainage is in metres tho!) - and make sure they are inspecting it at the right intervals, so ask for the last 2 reports.

yep i got the inspection reports with the letter they go right back to the 22nd of july last year,they dont really say much and a lot of it is gobbledigook

I've been arguing over damage to my previous car for over 18months the only way to get any money out of them is to take them to court. :mad:
