View Full Version : I've been shafted on eBay - Fraud claim with Paypal
I bid on a eManage from the USA last month..... the seller was really good at the start. Then after I paid him, it turned into a nightmare. I eventually filed a complaint via eBay and he said he'd been in hospital, but I checked his feedback and he was still buying and selling!! :mad:
Filed a fraud claim with Paypal tonight, I just made the 30 day deadline.....
The guy has "ok" feedback, all from sellers though :( (couple of negatives), but all I saw was the positives when I placed the bid. Now looks like most of his positives are from the sellers he bought stuff off with my cash :rant:
I've bought shed loads from eBay, never had a problem, and then I get this w@nker :furious: :annoyed:
Anyone going to Texas USA? I'd pay sh1t loads to have someone work this fcuker with a blow-torch and a pair of pliers....:wack:
What really p1ssed me off is that I paid $64 for 3-5 day delivery!!!

I know exactly how you feel mate. I bit the bullet and signed up to ebay to buy a CPU that is kinda hard to get hold of - turned out that the "brand new, never used but box has been opened" had infact been fitted and broken by means of incorrect fitting. My problems started when, not realising the potential risks I paid by cheque, which is electronically untraceable.
Took me a month to get anything back off him due to similar claims and eventually my threats of using the buyer protection scheme seem to have possibly paid off. A cheque turned up the other day which I have a bad feeling is likely to bounce.
Why are these people allowed to live?

I was amazed when I found out that you get cover through eBay, Paypal and credit card. Thought I'd have to bite the bullet, but looks like even if he does a runner, I can claim from Paypal...

:rant: I just went onto the lloyds site to check if the cheque had cleared and noticed the time.... lloyds stop people logging onto internet banking for updates between 12am-4am. Why can't they do it between 1-5am instead of 12-4am :annoyed:

Yeah that annoys me........crp really......
saying that until recently Lloyds did not update your account if you took money out etc,....until the next working day...so you could be overdrawn all weekend and not know it......
I was always complaining.......Halifax had this sorted years ago....(about 1996)

Did anyone on here read that topic on Scooby net a while back.Lad bought an ex demo Evo 8 and won it.Then the seller told him they'd already sold it before the auction ended.He posted his story on Scoobynet and it blew way out of proportion.The company that sold him the car ended up getting so much bad publicity that they let him have the car for the winning bid $26,200 i think.

I tried ringing him, but the phone number and address he gave eBay was incorrect. :annoyed: So I don't have any contact information, other than email....
It's a different story with Paypal though ;) , they must have his delivery address for all the cr@p he's bought. I'm sure they'll get him, but all that'll happen is he'll change his eBay account and continue to p1ss people off.

Not sure if any sellers will disclose his address, but I'll give it a try.... at least it'll give me some peace of mind if I know where he lives.....

<b>The conclusion......</b>
1. Paypal contacted me today and said they won't cover my loss with their protection program because the seller had less than 50 items of feedback (one of their refund conditions) :annoyed:
2. I got his home address by contacting all of the people he bought stuff off. I don't have his direct phone number, but I rang the management company of the appartments he lives in and they confirmed he lives there :(
3. He's closed his ebay account and has robbed at least one other ebayer who contacted me.
4. I have now filed an ebay claim and the maximum I'll get back is £100. If I pass all their conditions.... :(
So the outcome is that crime pays..... He gets to keep £300 of my cash!!!! and £176 of another ebayer :rant:

Is there a chance you can still make a charge back - through your own credit card company rather than PayPal? Not sure about the time limit but if you explain the situation to them, and that Paypal have not dealt adequately with your complaint - it might be worth a try. If that goes through, then they will just take the money back from Paypal and it will then be up to them to sort.

Just checking and I think you have 60 days from the STATEMENT DATE on which the charge occurs to make a claim. That may be wrong as most pages I found were US based, but take that as a guide (check conditions of your credit card). You may need to submit a written account of whats happened to your card issuer.
If they proceed with a chargeback, Paypal have to cover it, and they will then go after the little bastard to cover both the amount and the extra charges on top.
If you paid PayPal by Credit card and didnt recieve the goods you dont have to pay your credit card company?

I used to work in cards.
Possiblly not get your money that way as you paid paypal for electronic funds which they gave you and transferred.
Worth a try though.
I rekon nissmo freek and a baseball bat is a good bet.

Looks like Paypal are just as bad as the seller. When you read their wording, it says "To have your claim reviewed by PayPal the following requirements must be met: "......
So what they are saying is that they will "review" any claim..... But they have different rules for paying out :( (one of which is 50+ feedback)
I'm gona have a pop at them over this, cos they make out you're covered. They did sod all for 30 days and then I got an automated response saying "case closed" and "the seller is as fault, but didn't refund your money...."
Unfortunately I am now over 60 days. I thought I was covered by paypal, so didn't talk to the credit card company. I phoned them today and they are closed till monday....
However, I just checked through the credit card details and they say I have 45 days from transaction to lodge any fraud complaint.....So it looks like everyones wormed out of it cos I'm day 60.... I feel like I'm gona throw up.

Just ring up your credit card company and be as nice as pie - you want the person to be on your side, so don't winge at them. Then if you don't get your way be polite but firm - It always works for me, I got 6 payments taking off my bank account when I had a dodgy cheque from a car dealer.
