I'm just about to send my NIP off and likely to have to go to court (101 in a 60)

Question is, if they give me a court date can I change it if I can't make it (i.e going on holiday)?

Just deciding when to send the NIP off.

Cheers

They will change it but they will want proof of the holiday where you are going and staying etc 101 in 60 tut, tut that will be a ban and big fine I think, good luck!

Agreed,

They set a date and you are summoned on that date, unless you have a real good reason you'll most likely be convicted in your abscence and just sent the result.

That way you would't be able to argue the toss!!

If you are going away on holiday in the near future it would be worth putting a covering letter in with the NIP to explain that you could not attend any court (if necessary) on such and such date.

is this your last holiday before the fine then? :D :D

You ought to be able to get an ajournment without too much problem. Just tell them you need time to consult your solicitor or something.

First thing - sos wrong section.

I'm off on holiday on 4th August for a week.

The NIP has to be back in on the 2nd August.

Think I might send it just before I go. They are not likely to have a weeks turnaround are they? Or are they?

no fear bud. mine wasnt for a little while after that. They have to fit you in with all the cocaine losers caught for shoplifting etc....

funny thing was, I was a security guard (a damn good one) and so when i went in I knew all the people waiting to go to the court next door to mine :D

thought i was gonna get lynched :D

It isn't a problem changing court dates.

You need to ring the court and ask to speak to the listing officer. Explain why you can't make it and ask if it would be possible to change the date. If you have a valid reason like a booked holiday they will be happy to change it. The listing officer won't care what day you go into court. Just be poilte. You will also be asked to confirm it in writing.

If you are worried about it pm me and I will try and mail you. I am really busy at the mo but I get the odd chance to reply. Also are you pleading guilty. I would plead not guilty myself and fight tooth and nail. Innocent until proven guilty. At that speed you have nothing to lose. In fact, if you are in court it pays to keep putting it off. The longer it takes the better. If you take 6 months to go to court and then get points, you have had six months without points when you should have had them and arguing with a copper in the dock is better too. Cos he won't remember jack shit but you will remember it like it happened yesterday.

You might get away with no ban. It isn't automatic. All the same, I wouldn't take it lying down.

Last time I'll be able to afford anything!:(

The trouble with 200s:

I was karting in Wales that day (middle of nowhere). Just had a look on the karting forum - everyone else only managed 85. Obviously inferior cars!.......or more inteligent drivers!

As security guards are not part of the emergency services, thank god because then we'd be living in a vigilante state, it makes no difference.

Matter of opinion.

No-one around, on an A type road, speed limit rubbish for road type blah blah

courts were in agreement, got off with no points, and rightly so. paid my fine and ban of 21 days.

Since packed in that job :D

Yeah, thats what i got caught as... but Instead of arguing the point that its a 40 i just put me head down and got off. Be a bitch in court and you only do yourself harm...

Damn, I've lost count now :D

No you are totally right. It was the implication in your reply that because you were a security guard you had some sort of devine right to do as you pleased.

But still, the offence was bad enough for you to get a ban. If you had really been doing 64 in a 40 zone you shouldn't have been banned. Therefore, if must have been 30 zone. Either way you seem unsure.

:)

3 weeks after passing my test I was caught doing 67 in a 30, unmarked car followed me for about a mile as I undertook about 15 cars into a buslane then pulled me after the next roundabout.

(Dereham Rd, heading into the city from Costessey for the locals)

He gave me a NIP. Went to court 7!!!! times and represented myself in court.

5 points & £60 fine

I'm very surpised you didn't loose your liecense for that, speeding penalties seem to be very inconsistant these days.

Big wide open road in Wales in the middle of nowhere- nothing to hit apart from the odd sheep!

Police were only there because there was a kart track there.

Just thought I'd explain myself....... still stupid I admit

I wouldn't fancy your chances if you did hit a sheep at over a ton - but I know where you're coming from. Best of luck with the NIP and keep us posted. BTW are you pleading not guilty?

Turbo Pete - If they convict you in your absence am I right in thinking that they can't take your license?

Aaah, but what was your job at the time? Any job where you get a uniform means speed limits become optional ;) :D

Would you lose your job if you lose licence? If so you can make a hardship arguement. With a letter off your employer and a solicitor to do the talking for you you could maybe hang on to it. You could try and dispute that the gun or camera wasn't calibrated accurately and try and get the figure down as I think if you go over 100 it's a ban?

SpeedyPete

If you say your in sales and are constantly on the road thats currently their only argument - ie. like truckers, taxi drivers, bus drivers etc.

I said i was in tech support and needed the car for site visits which they took into consideration.

One thing that did make me laugh was that they suggested i cycle to work every day.

my work was 7 miles away and i lived in the countryside!!!

Er

So the Magistrate told you to get on your bike, is that what you're saying?

we do them all the time in work. You need to show you will suffer financial hardship if lose licence and your employer needs to do a letter on letterhead that says you will not be able to perform your duties/job without licence
