I'm on the campaign against pointless speeding fines again.

Just got my mate off two camera fines so I'm on a roll at the moment.

Now, heres the question.

As I understand it the police are not supposed to break the law without good reason. So if you are speeeding at 95mph they can break the limit in order to catch you. But if they are late for lunch they should be abiding by the speed limits.

So what is the score regarding parking on hard shoulders and slip roads of motorways.

For you an i it is illegal except if you break down. WHY - because it endangers other peoples lives.

So what happens if the cops are parked up in order to measure speeds. That is endangering other road users lives needlessly. They could use a designated parking bay or a flyover.

I am sure there was some stuff in the news recently about the ACPo saying that they couldn't do this sort of thing. I need to find it.

I am working on a case where a copper did this and would like to look into a private prosecution against the police officer for breaking the law. He conveniently wrote it in his statement.

Anyone know what the score is regarding this sort of thing

Pete,

You should officially be known as SXOC Legal Adviser:thumbs:

AFAIK you are correct in that they may only "bend" highway regulations in relation to a qualifying "serious incident".

They are not allowed to use the blues to skip traffic etc unless it is for a reason.

While your there see if you can ban speed bumps as an obstruction

The speed limit is 30mph, yet these speed bumps obstruct my driving, and reduce me to 10mph, that means they are just like pot holes and illegal.

Im sending the council my bill for the suspension if it collapses

IIRC ( from 5ive-0.com ) Cops can disregard laws "in the pursuit of their duty", this includes parking in stupid places to try & catch someone doing 5mph over the limit. It's left very vague & pretty much anything is open. But - if they cause an accident while breaking the law they will get done big time if their Boss thinks they were being stupid.

All ( most ? ) "safety" vans are staffed by civies & cann't just park anywhere. I keep reporting the one on the B4100 for driving on a footpath, but so far FA has been done about it.
