Hi

We got any legal eagles on the board????? If so any pointers with what to do with the following????

I'll apologise now if it turns out to be a long post!!

My parents just had the Traffic police at the door this morning. They were checking my dad was the owner of a such and such car etc etc. It was to do with an 'incident' in a supermarket car park. 'Seemingly' my dad reversed into a car, got out the car and then did his shopping!

A witness seen this happen and must have told the owner of the so called car he reversed into! Now, this was meant to have happened on 22/04/03. My dads car has no mark what so ever on his car! And he would certainly know if he hit a another car.

The witness is claiming my dad reversed into the space, got out the car then went to the rear of the car to look, then proceeded to go into the shop.

I can vouch this is what my dad does everytime he parks. (not reverse into cars) He always reverses into a space to ease getting back out. And once in the space he always goes round to the back of the car. The reason is to signal to the dog to 'stay'! Hence the reason the witness thought he was checking the car for damage!

we need to get in touch with the WPC that took the statement first (she's not in today!) The traffic police reckon they will just claim off my dads insurance! This can't be right as he never hit anyone. To me it sounds like someone else has damaged this other car and they are trying to pin the blame on my dad.

What should we do in this case, obviously there is no way he wants a claim
on the insurance for something he didn't do.

Really grateful for any help with this matter.

First thing to do is to contact your insurancer company and let them know that you do not wish for them to pay out at all since it is a fraudulant claim. Don't know if they still do it but insurers used to do a knock for knock routine whereby each company would cover their own damaghes. thing is you end up with a claim on your policy.


If u have legal cover as part of your insurance I would let them deal with it.

I thought that as it was a supermarket car park, then its private property and not a public road. Hence, no ones insurance is valid anyway, and entering a supermarket car park is done at your own risk.

Only claims for deliberate damage can be reported to the police in such a car park.

If this is not the case I'd be interested to hear.

No, your insurance must extend to everywhere cars are driven and that includes car parks whether privately owned or not.

Ok, folks aren't long of the phone to the original copper that took the statement from the other party.

In a nutshell what is going to happen is.......................






















Bugger all. The damage 'seemingly' caused was very very minor! The police just have to get details of the 2 'allegedly' involved cars and file it as its a reported RTA!! The other party aint bothered seemingly.

All my dads worrying over nothing

So, if someone hits you in a supermarket car park, are you saying that you can claim off their insurance for the accident ?

It always used to be that ins co's wouldn't pay up in private car parks. Has this changd over the last few years ?

I think its because of a change in the law. Car parks used to be considered private property so speeding, messing about like doing dohnuts etc wasnt illegal as such.

Now its regarded that anywhere that has public access, even though privately owned, is covered by the same laws as the open road.
