I've just been run over by a tractor :(

I was doing the stupid thing of braking excessively harshly cos I missed a junction in a singletrack road and was just about to nip across when I realised Mr Tractor in one of those shiny new (FAST!!) 4x4 tractors had gained on me more than I expected (Stupidly didnt check the mirror before lamping on) and he just couldnt stop in time (towing a massive amount of poo). He gently rolled into the back of my pug with a sickening crunch. Entirely my fault I spose, not wanting to risk my insurance NCB and not having caused any damage to his (No, Sh$t, its a monster truck!) I asked if he minded me not getting his details :D.

Lesson learned with minimal damage - I'll not be doing that again I can assure you. I'm glad I was brought back down from 'invincible' land lightly.

Ahh well, £40 should have that replaced and sprayed when I get the chance - thank god for scrapyards :)

errrrr. It was his fault. He drove into the back of you. If his vehicle cant brake properly, then he should be further behind. All you would have to say is "I thought I saw a small child jump out of the bushes in the corner of my eye"

I did consider that point, but having known of at least two other people who, in similar situations, got shafted for a 50:50 settlement I wasnt about to risk it :( It'll cost me a minimal amount to repair and I dont have to worry about getting any amount of blame - its just not worth the hastle. This country's laws and lawyers are screwed up - you guys all know that - everyone gets shafted someway in an argument these days. Like i said though, I do accept I braked without 'due care and attention' !!

Ta for the support but I'll just shy away from the argument and accept the cost this time :mad:

if he crashed into the back of you, there's no despute. It's his fault.
If he didn't have enough space between you and him for the speed he was travelling, it's his responsibility

Thats not the way it panned out when my dad hit the back of someone who slammed on on a slip road in front of him - he didnt get the full blame, he got 50:50. Its not as cut and dried as everyone thinks unfortunately.

No point cryin over spilt milk now though, its done and dusted and funny when I think back and remeber wondering if he was actually going to go right over the top of me or not! He managed to swerve off to the left slightly which helped, or I'd have been hit by a whopping great concrete block that was mounted on the front. Surely thats against safety laws??!!

I always believed that if someone hit the rear of your car then it was his fult, until it happened to me and I was told by my insurance company that in these cases they are generally regarded as a 50:50 for exactly the reason of people slamming the brakes on excessively hard for no good reason, just like coyoteboy:):(. Its fooked up but I suppose it makes sense.

yeah, I'd accept half the blame in this instance, if I was forced to. BUT it doesnt make it right i dont suppose as he should have been sure he could stop anytime in case a kid ran out on me.

Well, like i say, i deserve half of it this time and for that reason I'm glad it was a 20 ton truck and not a 200! :)

Sorry in advance for being one of the fools who slams on! As I said, lesson learned.

My first write off involved me hitting the back of an 84 year old woman on a 60 mph, straight, clear 'A' Road.
She had stopped dead in the middle of the carriageway because, as she later told the police "I thought there was a roundabout" :eek: :mad: :confused: :rolleyes:
I only hit her because my concentration was knocked by the evasive action the car in front of me took.
Needless to say I got stuffed - lost NCB, and all £1800 worth of car (I was TPFT).
Then the old witch tried to sue me for dangerous driving!!! :eek:

I reckon you could have claimed against him - as you say, for £50 odd worth of damage its not really worth the hassle though.
I think a sliproad is different anyway - why would you need to slam the anchors unless you were going to reverse back up it?? (i.e. dangerous driving)

Lewis: Yes, I'm glad it was as light as it was. All praise to the tractor guy for doing his best to avoid me and only a little crunch - the size of that thing he could literally have gont right over me if we'd have hit at enough pace.

Docwra: In my dads case, in the sliproad, the guy has stopped once, accelerated away then slammed on again. As it was clear my dad had just gone when he did and was checking over his shoulder for more traffic (which there wasnt any of so the other guy must have been seeing things or something)

My biggest problem now is getting to uni in that state. Mr Police person I asked said I was OK providing the car wasnt going to crumble and the lights were painted the correct colours 'til I get a new lens. My girlfriends glass painting paints came in handy after all!

Doesn't look too bad does it - just a tailgate and light cluster and maybe bumper if you can be arsed 'cos it looks cracked to me :rolleyes:

@Coyoteboy - you action was probably spot on - its not really worth the risk I suppose for the sake of a rear light cluster and light damage.

I've driven into thte back of another van before at about 2 MPH in a traffic jam (was checking out this fit blonde in the car just up the m/way)
We just parked up, he looked at his damage (slightly bent frame under rear bumper), I looked at mine (fromt bumper slightly pushed back) and he said thats OK he didn't care, but I gave him all the money I had anyway out of guilt (£10).
Often its best to settle these things without the insurance knowing.
