View Full Version : Driving w/o due care & attn.
What kind of a penalty does this bring? Pleading guilty in court. voluntarily went to the police station at half ten on a sunday (was also my birthday) night to give finger prints, dna, photo's etc and interview.
It started out as dangerous driving and has been dropped to the subject line. This has been going on since the start of july last year when i had my civic and is at court on the 31st of this month.
Any info greatly appreciated
Forgot to add, its nothing to do with speeding, crashing etc. Basically i left a car park abit heavily footed and lit up the front tyres, a PS (police sargeant) saw it and stopped me and hence the above :(
Are you sure it was the heavy foot that caused the wheelspin and not a combination of Deisel on th road causing the wheels to spin ???
Besides you were in a civic ? ........ I havenot seen one pull away with out spinning the front wheels all the way up the road .... I thought this was a design aspect of the car ????
Seriously though I wouldnt plead guilty in court, there are plenty of reasons for spinning he wheels on a car. ???
Its too late im afraid, whilst in the interview the PS was grilling me and I slipped up and said on tape that what i did was not dangerous but was careless, hence they have dropped it to driving w/o care. Even my solicitor said theres no point in pleading not guilty cos if they find me guilty which they prob will he said i'd get worse than i would for pleading guilty. Plus he said the court might take leaniance for me self admitting and he can make a mitigation plea? that it was on a car park and not a public road and that no one was endangered.
He probably wouldnt of seen me if the zorst wasnt so god damn loud. It was louder than a nur spec :eek:

Happens all the time here in the US... called Exhibition of Acceleration. Its a lovely fine and its hard to fight.

Yes, it was careless, esp when you consider that you were on an invisible patch of diesel at the time... ;)

At least they give it a name fitting to the crime ... Exhibition of Acceleration is against the law ... no wheel spinning ..... its a bolox law, but at least they are open and fair about it.

I dont see it being careless unless you were surrounded by children (were you ?) or had a baby unsecured on the roof of the car ????
Now if the law said in no shorter words "Thou shall not wheel spin" ...... then fair play, you broke the law, stiff upper lip and all, take it on the chin boy .............. but careless driving just sucks ... it was a FWD car, all you do is take you foot of the go pedal and you stop ... none of that dangerouse fishtail RWD stuff.

Aggressive Acceleration.... you can get done if you accelerate too fast EVEN if its within the speed limit...

And with all the media scare tactics of terrorism, you thought he was a ninja terorist arab ... and you were trying to kill the PC to save hundereds of lives ???????

I'm surprised its even going to court...unless you decided you are going to refute the claim.
I was involved in an accident, my fault, and the police turned up. They charged me with driving without due care and attention (CD10). Something came through the post which basically said if I admit I was guilty then pay the fine (£200) and get 3 points on licence. Otherwise, go to court and see what happens.
If you're going to plead guilty then why do you have to go to court to do that?...

no it was 11 at night and no one about until he popped up with his moving xmas tree.
When I first explained it my solicitor he said it was rediculous also and said we will plead not guilty, so they sent him a copy of the tape and written version for use in court which I admitted it was careless not dangerous cos he was badgering me about the dangerous bit. my solicitor then said we are goin to have to change the plea because i self admit it was careless not dangerous.
i hope i only get 3 points, can you pay a higher fine and have no points?
A mate of mine got done for this not so long ago ( having an argument with his G/F so did a wheel spin to try scaring her into shutting up - lol ). He got 3 points and about £200 fine.
cheers for the replies guys, i thought i was up for the high jump but 3 points isnt so bad. still a downer but better than 6, hope i do get 3. just have to see what happens now

They tried to do me once for this many moons ago........
I told them that the hand brake had stuck a bit making it difficult to pull away, as I applied a little more throttle my hand brake mysteriously released itself......
Nowt they could do.....:)

I was threatened with "driving without due care and attention", and yes i did deserve it, i'd just shortened a BMW 523 by about 3 foot with my landrover (even the copper laughed :D, before letting me drive mine home (chuckle chuckle))
Teach him to pull out in front of me wont it......whats that? the lights were red, oh ok then....
Anyway, i was given a choice......either go to court with afformentioned or do a driving course that cost £130.
Driving course was a piece of piss and didnt hear any more about it.
You might be told to go and do that........
i think thats why it is going to court, ive already done the course but it wasnt my fault. i was coming up to a set of lights one day and the car infront of me hit the car infront of him. he said he thought i was going to hit the back of him so he went to far and hit the car infront of him. cops came and did the usual, then he came round to my house about an hour later to get statement etc, they informed my insurance company but they wrote to me sayin you havnt hit a car so we are not involved and your insurance is not infected (good stuff) but he said cos im a young driver (i was just 18 at the time) he said i would get the blame, which i did and ended up on the said course.

yep, i had to do the driving course or go to court and try and prove my innocence. the guy who hit the car was blaming me and the women he hit wasnt interested as long as she got a new bumper. so, yet again i drew the short straw. i dont think the justice system likes me
Well ..... being done for witnessing an accident and now being done for a minor wheelspin offence due to having a sticking handbrake on oil whilst trying to kill threatening arabs.
If this isnt a cought case for Police harrasment and a £10,000 compensation fee ... I dont know what is ....... can you get them to beat you up a bit as well ???

this realy sucks,I`ve been in this situation and the first thing the coppers do is try to get you to admit that you were being dangerous and careless and if your not clever enough to keep your mouth shut they`ve got you(I was`nt)
Still your lucky to have got them to drop the dangerous driving bit as that carries a 10 point penaulty regardless of what you did.

Sorry to hear that mate, hope it goes well.
I personally dont have much bother with wheelspin even with 235bhp (joys of all wheel drive :) )
Anyway the DVLA website (http://www.dvla.gov.uk/drivers/endorsem.htm#Miscellaneous%20Offences) lists it as 3-9 points, dangerous carrying 3-11 points.

Its a law in certain US states so I have heard. They (the law) can do pretty much what the hell they like over there.

Anyway lesson for everyone out there, never, ever admit to anything when these slimeballs talk to you, they WILL try and trick you. Just tell them you are not prepared to answere any question untill you have sought legal advice.
Better still tell them to FCUK OFF, you usually get away with one swear word, or a few in one sentence.
Routine application of dog sh't under their car door handles might help you to feel better.

so are u saying that u underwent a police interview without a solicitor:eek: :eek: the only time ive done that is when ive been as guilty as feck and wanted as least hassle as poss and behave very apologetically, otherwise its always a case of remaining silent. remember it is their job to prove, first to the cps that they have a case thats worthy of possibly getting a conviction. then going to court and convincing a jury, why do u think that there are so many nasty crims walking the street. as for the dna tests, if ever you have committed a crime in the past then expect a knock at the door soon. more and more murderers and rapists are being caught for motoring offences first.

no i am most certainly not. but apparantly rapists and murderers have been known to drive cars, so, seeing as the cops are crap at catching anyone except motorists they are on to a real winner hear, nick as many motorists as possible for as silly a reason as possible, dna test em all and eventually ....... yep uve guessed it.

I was trying to do just that tonight on the way home!!!
Had a copper car in front of me on the DC so I accelerate past him at 70mph, then at every set of lights and junction etc, I was trying to get him to bite by wanging it up to speed limit REALLY quick....:D
Quite a few 60's around here as well, ............he didn't bite though. :(
Probably wouldn't have had a case anyway with no evidence and, the speed limit said 60mph....not, upto 60mph within 400 yards and not quicker than 50 secs to get there..........:rolleyes:

A cop in the US can knick you for ANYTHING... he can always make up stuff. "You spun your tires at that light", "You didnt stop before the white line", etc. etc. And when the cop shows up to court there is nothing you can do to avoid it.

Went to court this morning, and I got 5 points and £200 fine with £65 court charges. Only in there 20 mins, room werent much bigger than my bedroom. Oh well, another lesson learnt

Still, a major criminal such as yourself deserves all the Police / Court attention you get, means "they" don't have to bother with those "petty" muggers, rapists etc

Pull out onto the first lane of the motorway, then accelerate causing a truck or two to swerve and tip over blocking the whole motorway. Then you've got nice clear road ahead of you :) :rolleyes:
