I desperately need your help, I got caught driving (well more like scooting as the engine was not on!!!!) a GO-PED (a glorified scooter with an engine) by the boys in blue. I have now been summons to court on 9 offences which include, driving a vehicle with no MOT, TAX, Registration, no helmet and no insurance, i was under the impression you didn't need these on an off-road vehicle?

i think they are just trying it on as i wasn't even on the road and the engine wasn't even on?

where can i get some decent advice as every solicitor i have rang say they have never heard of a case like this, therefore cannot help

i was caught scooting across the road ie on the pavement NB the engine was not on

OK. There was a case several years ago where it was thrown out of court as the vehicle i.e. the scooter was not actualy a classified vehicle. This means that no one was legally sure what it was eg. moped, scooter etc.

2 years ago the police in Torbay were hanging back from taking anybody to court as the legal position was unclear. This may have changed by now.

You need to find the relevant law so search motor law sites. You may find information on drivers right sites such as MAG (Motorcycle Action Group) try the AA and there is another aimed at car drivers which I can't remember do a search using your browser.

What you are looking for are cases that have been thrown out of court or the defendent found not guilty as this sets a precident and can be used as part of your defence. The legal system in this country works on the theory of precident.

Forget using solicators for gaining information use the web, but if you find case law then make note of it ,print it off, and take it to the solicator who will be representing you as he can use the info.

im gonna have to get a **** hot solictior, i think lads as this is a GREY area of the law, but i'm thinking about getting the paper etc involved to highlight how stupid the police are being???good idea do you recon

Someone has actually been successfully prosecuted for riding one of these without tax etc:(

Unfortunately I don't think the fact that it wasn't running is going to help much:(

Police have successfully prosecuted a rider for wheeling an off roader along the road before.... No helmet, tax, insurance, etc etc
